Terms of Service
The agreement between you and Samling. Read it together with our Community Rules and Privacy Policy — the three belong together.
1. About Samling and these Terms
Samling is an ad-free, European community app for closed groups, events and coordination. The app is provided by Toysi ApS (VAT no. DK40231110), a company registered in Denmark.
These Terms of Service are the agreement between you and us when you use Samling. They should be read together with our Privacy Policy and our Community Rules — the short, plain-language text you accept when you create your account. The three documents tell one consistent story: the Community Rules in everyday language, these Terms in legal form, and the Privacy Policy on how we handle your data. Our Cookie Policy additionally describes the few cookies samling.net uses.
2. Accepting these Terms and who may use Samling
By creating an account you confirm that you have read and accept these Terms and the Community Rules, and that you have read the Privacy Policy.
You must be at least 15 years old to use Samling. If you are below the age required in your country to enter into this kind of agreement, you may only use the app with the consent of a parent or guardian.
If you use Samling on behalf of a group or organisation, you warrant that you are entitled to accept these Terms on their behalf.
3. Your account
You are responsible for your account and for keeping your login details private. Tell us as soon as possible if you believe someone else has gained access to your account.
You must provide accurate information when signing up and keep it up to date. An account belongs to one person — do not share it. Your account is personal and may not be transferred, rented out or sold to others.
4. Community Rules and acceptable use
The Community Rules are part of this agreement. In short: you may share images, videos and messages that you have the right to share, create groups and invite others, and you are expected to keep a good and respectful tone.
You must not use Samling to:
- share illegal content;
- share sexual material of or about children — this is always reported to the authorities;
- share sex videos or intimate images of others without their consent;
- harass, threaten or bully others;
- impersonate another person;
- send spam or otherwise abuse the platform;
- access or collect data from the service by automated means (such as scraping or bots) without our prior written permission;
- attempt to circumvent technical limitations or security measures, decompile or reverse engineer the app, beyond what mandatory law expressly permits;
- commit fraud or other unlawful acts.
You are responsible for the content you share and for having the rights to it.
5. Your content
You keep ownership of the content you share on Samling. So that we can run the service, you grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce and display your content — solely to the extent necessary to operate and provide Samling, and solely to exactly the audience you choose (for example a group, or the people you share with). The licence ends when you delete the content or your account, except as needed for backups and legal obligations. We do not use your content for advertising and we never sell it on.
Comments you delete are removed by a “soft delete” (marked as deleted) so that conversation threads do not break; they are no longer shown to other users.
6. GIF content
The GIFs you can search for and insert in Samling are provided by heypster, a European provider that creates and moderates all of its own content. heypster is responsible for the GIF content it supplies, in line with the EU Digital Services Act. The GIF search interface is clearly labelled “heypster”.
7. Enforcement and sanctions
We do not proactively monitor private conversations. If we receive a report or otherwise become aware of a breach of the rules, we may — depending on how serious it is — choose to:
- remove content;
- give you a warning;
- restrict features on your account;
- close your account permanently;
- contact the relevant authorities where the law requires it.
Sanctions generally escalate from a warning to permanent exclusion, but serious violations (such as illegal material about children) may lead to immediate closure and a report to the authorities.
If we remove your content, or restrict or close your account, we will give you a statement of reasons referring to the rule that was breached — unless the law prevents us from doing so. If you disagree with the decision, you can complain by writing to [email protected], and we will review the case again. This right to complain does not affect your right to go to court or the further options available under the EU Digital Services Act (DSA).
8. Reports
You can report content or a user directly in the app. Moderation happens on the basis of reports — not by automatically reading your messages. We handle reports as quickly as we can.
9. Subscription, storage and payment
Samling is free to use with a 500 MB data pool per account. With a paid subscription you get a larger data pool (30 GB with Premium, 120 GB with Premium+), and paying subscribers can buy additional storage. Groups and events are unlimited — it is only the amount of data (images, videos, files) that counts towards your storage. The current prices and data pools are always shown on the pricing page at samling.net.
The Free plan is intended for private, non-commercial use — for example families, friends, associations and clubs. If you use Samling for business purposes, we may ask you to upgrade to a paid subscription.
Payment is handled by our payment provider Mollie in a secure browser. We do not charge through Apple's or Google's in-app purchases. Subscriptions renew automatically until you cancel, which you can do at any time in the app or on samling.net.
Cancellation and expiry
If you cancel your subscription, you keep access to your paid benefits until the end of the period you have already paid for; after that the subscription is not renewed and your account moves to the Free plan. There is no refund for the remaining part of an ongoing period, unless mandatory law entitles you to one. As a consumer you also keep the withdrawal and cancellation rights granted by Danish and European law.
Price changes
We may change our prices. Price changes are announced with reasonable notice — at least 30 days — in the app or by email before they take effect for you, and a new price applies at the earliest from your next renewal. If you do not wish to continue at the new price, you can cancel your subscription before the renewal.
10. Operation, changes and our liability
Operation and changes to the service
We continuously develop Samling and may change, add or remove features, and the service may be temporarily unavailable during maintenance, updates or operational incidents. If we remove a significant feature, or shut the service down, we will give reasonable notice so you have time to retrieve your data.
AI-assisted support
Enquiries to our support may be answered in whole or in part by an AI-based system. AI-generated answers may contain errors and should be assessed critically; they do not constitute legal or other professional advice, and you can always ask to have your enquiry handled by a human. The AI does not make automated decisions with legal effect for you — such as suspending your account or removing content; decisions of that kind are made by humans.
Limitation of liability
We work to keep Samling stable and secure, but the service is provided without any guarantee of uninterrupted or error-free operation, to the extent permitted by law. We are not responsible for content that users share.
To the extent mandatory law does not prevent it, we are not liable for indirect or consequential losses, including loss of business, lost profits, loss of data or losses caused by the service being temporarily unavailable. We recommend that you do not use Samling as the only place you store content that matters to you.
Force majeure
We are not liable for failure to perform our obligations to the extent it is caused by circumstances beyond our reasonable control — such as power failures, outages at subcontractors, war, natural disasters, cyber attacks or orders from public authorities (force majeure).
Nothing in these Terms limits the rights you have as a consumer under mandatory law, or any liability that cannot validly be excluded.
11. Termination
You can delete your account at any time in the app or on samling.net. We may suspend or close your account if you breach these Terms or the Community Rules, as described in the enforcement section.
12. Changes to these Terms
We may update these Terms, for example as the service evolves or the law changes. For material changes we will ask you to accept the new Terms the next time you open the app before you can continue. The version number at the top shows which edition applies.
13. Governing law and disputes
These Terms are governed by Danish law. If you are unhappy, we would very much like to hear from you at [email protected] so we can find a solution. Complaints about how we handle personal data can be directed to the Danish Data Protection Agency, Datatilsynet (datatilsynet.dk). As a consumer you may also be able to complain about a purchase to the Danish Centre for Complaint Resolution (naevneneshus.dk), if the conditions for doing so are met.
